Terms of Service

Welcome to MNLY. These Terms of Service ("Terms") govern your access to and use of getmnly.com, the MNLY mobile and web applications, the MNLY lab testing program, and any other products or services we offer (together, the "Service"). The Service is provided by MNLY, Inc. ("MNLY", "we", "us"). By creating an account, ordering a kit, or otherwise using the Service, you agree to these Terms.

1. Eligibility

To use the Service, you must be at least 18 years old, a resident of the United States, and legally able to enter into a binding contract. The Service is currently available only in the contiguous United States, Alaska, Hawaii, and Washington, D.C. You agree to provide accurate information about yourself and to keep that information current.

2. Your account

You are responsible for safeguarding your login credentials and for any activity that occurs on your account. Notify us promptly at support@getmnly.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.

3. Subscriptions, billing, and cancellation

3.1 Recurring billing

Most MNLY plans are billed monthly. Your subscription begins on the date you place your first order. Your payment method on file will be charged automatically on each renewal date until you cancel. Billing is processed through our payment processor (currently Recharge and Shopify); your card details are stored with them, not with MNLY.

3.2 Commitment plans

Certain plans (including some bundled with on-site testing) carry a three-month minimum commitment in exchange for a discount. If you purchased a commitment plan, you may not cancel before the commitment window ends. The exact end date of your commitment is shown in your account settings.

3.3 Cancellation

Outside of an active commitment window, you may cancel at any time from your account or by emailing support@getmnly.com. Cancellation takes effect at the end of your current billing period; we do not prorate partial months. We do not provide refunds for unused portions of a billing period except where required by law.

4. Lab testing and kit activation

MNLY's lab testing is fulfilled by our third-party laboratory partner (the "lab partner"). When you order a kit, the lab partner ships the physical kit to you, processes your sample, and returns biomarker results to us. Your use of the lab testing program is also subject to the lab partner's terms and privacy practices, which you accept separately during kit activation.

4.1 Activation

You must activate your kit at getmnly.com/dashboard/activate before collecting your sample. Activation confirms your identity and links the physical kit to your account. Failure to activate before sample collection may result in your sample being rejected by the lab.

4.2 Retests

Most subscriptions include a recommended retest approximately every 90 days. Retests are customer-initiated - you will be prompted in your dashboard when you're eligible, and a retest kit will be ordered only when you confirm.

5. Health information disclaimer

MNLY is a wellness service, not a medical service. The information, scores, and recommendations provided through the Service are for informational and wellness purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you have regarding a medical condition. Do not disregard, avoid, or delay obtaining medical advice based on anything you read in the Service.

Lab results provided through MNLY are not diagnostic. They are intended to give you a baseline view of common biomarkers and to guide lifestyle and supplement recommendations. They are not a replacement for tests ordered by your physician.

6. Supplement orders

Personalized supplement packs are fulfilled by our third-party manufacturer, OK Capsule. We do not manufacture supplements directly. Statements about supplements are not evaluated by the Food and Drug Administration. Our supplements are not intended to diagnose, treat, cure, or prevent any disease. Consult your healthcare provider before starting any supplement, particularly if you are pregnant, nursing, taking medication, or have a medical condition.

7. Shipping

Kits and supplements are shipped to the address on file at the time of order. You are responsible for keeping that address current. We are not responsible for delays or losses caused by carrier issues, incorrect addresses, or refused deliveries. If your kit or shipment is lost, contact support@getmnly.com within 30 days of the expected delivery date.

8. Acceptable use

You agree not to:

Use the Service for any unlawful purpose;
Submit false or misleading information, including misrepresenting your identity or the identity of the person taking the test;
Attempt to access another customer's account or data;
Reverse engineer, decompile, or otherwise attempt to extract source code from the Service;
Resell, redistribute, or repurpose the Service or any data obtained through it without our prior written consent.

9. Intellectual property

All content, software, designs, trademarks, and other intellectual property associated with the Service are owned by MNLY or our licensors. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial use. You retain ownership of any information you submit to us; you grant us a worldwide license to use that information solely to operate and improve the Service.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms, misuse the Service, or for any reason at our sole discretion. Upon termination, your right to access the Service ends; sections of these Terms that by their nature should survive (including the disclaimers, limitations of liability, and indemnification) will survive.

11. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that lab results, recommendations, or other content provided through the Service will be accurate, complete, or reliable.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MNLY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold MNLY, its officers, directors, employees, and agents harmless from any claims, losses, liabilities, damages, and expenses (including attorneys' fees) arising out of your use of the Service or your violation of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration in Salt Lake County, Utah, under the rules of the American Arbitration Association, except that either party may bring an individual action in small claims court. You waive any right to a jury trial and to participate in a class action.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
